Terms of Service

Welcome to Certified Tattoo Studios. Our website, platform, and applications (the “Site”) are operated by Certified Tattoo Studios and Cercus, LLC. The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of the Site constitutes your agreement to all such Terms. Please read them carefully and keep a copy for your reference.

Your Account

If you use this Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your devices, and you agree to accept responsibility for all activities that occur under your account. You may not assign or transfer your account to any other person or entity. Certified Tattoo Studios is not responsible for third-party access to your account resulting from theft or misappropriation, and reserves the right to refuse service, terminate accounts, or remove or edit content in its sole discretion.

Electronic Communications

Visiting the Site or sending us email constitutes electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

Bookings, Payments & Deposits

The Site is an e-commerce platform used to book tattoo and piercing appointments and sell related merchandise. Payments and deposits are processed securely through Stripe. Where a deposit is required to reserve a session, that deposit is applied toward the final price of your service in accordance with the booking terms presented at checkout and the policies of the artist or studio you book with.

Complimentary Touch-Up Policy

Each qualifying tattoo includes one complimentary touch-up. To be eligible, the tattoo must be fully healed, which generally requires a minimum waiting period from the date of service, and the touch-up must be requested within the complimentary window (by default, up to one year from the date of service). Windows and eligibility are set by Certified Tattoo Studios and may be adjusted over time.

Exclusions. Certain placements are, by their nature, prone to fading, blowout, or uneven healing, including but not limited to the hands, palms, fingers, knuckles, fingernails, feet, soles, inner lip, and similar high-friction or thin-skin areas (identified in the Certified body map as “poor healing” placements). These areas are not covered by the complimentary touch-up policy. A studio manager may, at their sole discretion, approve a touch-up outside the standard policy.

Optional touch-up coverage. Where offered, clients may purchase optional touch-up coverage at or after booking to extend the complimentary window and/or to add protection for poor-healing areas. Coverage terms, pricing, and duration are presented at the time of purchase, apply only to the specific service purchased, and are non-transferable. Coverage does not guarantee any particular healing outcome and does not cover damage caused by failure to follow aftercare instructions, infection, sun exposure, or subsequent modification of the tattoo.

Intellectual Property & Acceptable Use

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. You will not use the Site for any purpose that is unlawful or prohibited, and you will not damage, disable, overburden, or impair the Site or interfere with any other party’s use of it. All content on the Site, text, graphics, logos, images, and software, is the property of Certified Tattoo Studios or its suppliers and is protected by intellectual property laws. You will not modify, publish, transmit, reverse engineer, sell, or create derivative works from any content without express written permission.

Third-Party Accounts & Links

You may connect your Certified Tattoo Studios account to third-party accounts. By doing so, you consent to the continuous release of information about you in accordance with your privacy settings on those platforms; if you do not want information shared this way, do not use the feature. The Site may contain links to sites not under our control, and we are not responsible for their contents; inclusion of a link does not imply endorsement.

Indemnification

You agree to indemnify, defend, and hold harmless Certified Tattoo Studios, its officers, directors, employees, agents, and third parties for any losses, costs, liabilities, and expenses (including reasonable attorney’s fees) relating to or arising out of your use of the Site or services, your violation of these Terms, or your violation of any rights of a third party or any applicable law.

Arbitration & Class Action Waiver

Any dispute arising out of or concerning these Terms that the parties cannot resolve shall be resolved by final and binding arbitration under the Federal Arbitration Act, conducted by a single neutral arbitrator administered by the American Arbitration Association. Arbitration will take place on an individual basis; class arbitrations and class, representative, or collective actions are not permitted. The prevailing party is entitled to recover costs and reasonable attorney’s fees. This provision survives termination of these Terms.

Liability Disclaimer

The information, software, products, and services on the Site are provided “as is” without warranty or condition of any kind. To the maximum extent permitted by law, Certified Tattoo Studios and its suppliers disclaim all warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and shall not be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with your use of the Site. If you are dissatisfied with any portion of the Site or these Terms, your sole and exclusive remedy is to discontinue using the Site.

SMS Terms

By opting into the Certified Tattoo Studios SMS program you agree to receive text messages related to your account and services, including appointment confirmations and reminders, follow-up care instructions, and promotional alerts. You may opt out at any time by replying STOP to any message; reply HELP for assistance. Message and data rates may apply, and carriers are not liable for delayed or undelivered messages. You must be 18 or older to use this SMS service.

Governing Law & Changes

This agreement is governed by the laws of the State of Colorado, and you consent to the exclusive jurisdiction and venue of courts in Colorado. Certified Tattoo Studios reserves the right to change the Terms under which the Site is offered; the most current version supersedes all previous versions. We encourage you to review the Terms periodically.
